Tough cases don’t settle themselves. Progress requires effort, solutions demand dedication. I started mediating because I believe every matter deserves a mediator who works hard to help the parties find their solution. There’s no substitute for preparation - nothing can replace putting in the time to understand the little details that form the “big picture.” Every mediator wants to settle cases, but mediators that roll up their sleeves and prepare actually get deals done.
Michael Corleone was wrong - every conflict is personal to the people involved. Usually the parties’ backstory is the foundation of the dispute - just behind the positions and the posturing that feed the conflict lie the interests that define the boundaries of possible solutions. The answer is there, but you have to know where to look. Accounting for the emotions and asking “why” opens the door to solutions to the parties’ problems.
